Sagar Singh @ Amit @ Zibra & Ors. vs. The State (NCT of Delhi) & Ors.
Background
The petitioners sought quashing of a 2019 FIR alleging attempted culpable homicide and voluntary hurt with weapons (Sections 308/324/34 IPC), arising from a scuffle-turned-assault between the petitioners and two brothers running a furniture business. The parties had since signed a Memorandum of Understanding settling their dispute.
Decision Breakdown
The two injured complainants appeared in court, confirmed the settlement, stated they had received compensation for their treatment expenses, and said the accused had apologized. Their medical records showed the injuries were simple and blunt, not caused by any sharp weapon. Applying Supreme Court precedent (Narinder Singh, Gian Singh) permitting quashing of even non-compoundable offences on genuine settlement where conviction is unlikely, the Court quashed the FIR, subject to the petitioners depositing Rs. 10,000 each with the Legal Services Committee.
Lesson Learnt
Even serious-sounding charges like "attempt to culpable homicide" can be resolved through genuine settlement when the actual injuries were minor and both sides freely agree to move on, though courts may impose a modest cost as a condition.
