Sanjay@Maandu vs. The State NCT of Delhi
Background
The accused sought regular bail in a murder case (also involving illegal weapons charges) registered at Police Station Bawana in 2020. While the matter was being heard, one of the Court's own law researchers pointed out that this was actually the accused's fourth bail application before the High Court, a fact he had not disclosed in his petition.
Decision Breakdown
Once this concealment was flagged, the accused's counsel sought permission to withdraw the current bail application, promising to file a fresh one that would honestly disclose all his earlier bail applications (whether anticipatory, regular, or interim) along with copies of the orders passed on each. The Court granted this request and dismissed the application as withdrawn, with liberty to refile on that condition.
Lesson Learnt
Anyone applying for bail must disclose their complete history of prior bail applications to the court. Hiding earlier attempts is a serious lapse that can derail a case, even if, as here, the court still allows a fresh, honest attempt afterward.
