Santosh Bakshi v. State of Punjab
Background
A woman reported dowry-related mistreatment by her in-laws, while her husband supported her. Police did not register the requested case and instead initiated proceedings for giving false information after her brother-in-law disputed her complaint. The High Court declined to quash those proceedings.
Decision Breakdown
The Court allowed her appeal and quashed the Section 182 complaint, approval and consequential proceedings. The authorities had not established that she knew or believed her information to be false, an essential element of the offence. The in-laws' agreement in domestic-violence proceedings to let her return and avoid further mistreatment also undermined a summary dismissal of her account. Police needed proper verification, including relevant people outside the family, rather than simply accepting the opposing relative's denial. The ruling did not finally convict the in-laws of the reported abuse.
Lesson Learnt
An unproved abuse complaint is not automatically a knowingly false complaint. Authorities must investigate seriously and establish the required dishonest knowledge before prosecuting the complainant for false information.
