Satyawati & Ors. vs. State of NCT of Delhi & Anr.
Background
The petitioners (in-laws of the complainant) sought quashing of a 2023 FIR filed by their daughter-in-law under Sections 323/354/354B/498A/506/509/34 IPC. After the chargesheet was filed, the parties were referred to mediation and reached a settlement agreement, following which the complainant and her husband resumed living together.
Decision Breakdown
With both sides confirming the voluntary settlement in person before the Court, and the complainant confirming she no longer wished to press any charges, the Court held that continuing the criminal proceedings, which involved a purely private dispute with no larger public interest at stake, would serve no useful purpose. Exercising its inherent powers, the Court quashed the FIR and all consequential proceedings, directing that the settlement affidavits be placed on the trial court record.
Lesson Learnt
Matrimonial and family disputes that are genuinely and voluntarily resolved through mediation, especially where the parties choose to resume living together, are strong candidates for quashing of the related criminal case, since continuing the prosecution would not serve any real purpose.
