Sesami Chemicals Pvt. Ltd. v. State of Meghalaya and Others
Background
A ferrosilicon manufacturer complained of an unpaid balance after dispatching goods to buyers. It alleged a later settlement followed by a stopped-payment cheque; the buyers alleged defective goods and that documents and the cheque were obtained under threat. The High Courts quashed both the initial criminal case and the connected cheque-dishonour proceedings.
Decision Breakdown
The Supreme Court allowed both appeals and restored both proceedings for action according to law. The facts concerning the transaction and alleged settlement were seriously disputed and required evidence at trial. A brief conclusion that the dispute was purely civil did not justify quashing the first case in those circumstances. The interconnected and contested facts likewise did not justify ending the cheque case, without the Court deciding whose factual account was true.
Lesson Learnt
A commercial dispute did not enable these accused to obtain quashing by having the court accept their contested version of events. Restoring the cases required examination of evidence; it did not prove cheating, establish the claimed debt or decide the cheque allegations.
