Sh. Uttkersh Mishra and Ors. vs. State (NCT of Delhi) and Anr.
Background
The petitioners sought quashing of an FIR under Sections 498A/406/34 IPC (cruelty and criminal breach of trust relating to dowry/stridhan) registered following a matrimonial dispute. The marriage between the first petitioner and the complainant had already ended in divorce by the time of this hearing, and no children were born from the marriage.
Decision Breakdown
The complainant appeared in person before the Court and, in a direct conversation with the judge in Hindi, confirmed she had received a complete and final settlement covering her stridhan and maintenance claims, and no longer wished to pursue the criminal case. Satisfied that the settlement was genuine and that pushing the parties through a full trial would serve no purpose, the Court quashed the FIR and all related proceedings.
Lesson Learnt
In matrimonial cruelty/dowry-related FIRs, where the marriage has already ended and the complainant confirms in person that she has been fully compensated and wishes to end the matter, courts will readily use their inherent powers to quash the case rather than force an unnecessary trial.
