State of Madhya Pradesh v. Babbu Rathore & Anr.
Background
The respondents were charged with murder and related offences (Sections 302/34, 404/34 IPC) along with an offence under the SC/ST (Prevention of Atrocities) Act after a man's body was found and the investigation pointed to them. At an advanced stage of trial, the respondents argued that because the investigation had been conducted by a police officer below the rank of Deputy Superintendent of Police, contrary to the mandatory rule for SC/ST Act offences, the entire investigation, including the IPC charges, was illegal. The trial court agreed and discharged them from all charges, and the High Court upheld this.
Decision Breakdown
The Supreme Court held that the rule requiring investigation by an officer of at least DSP rank applies only to the offence under the SC/ST Act itself, not to ordinary IPC offences investigated by a competent police officer under the Cr.P.C. Relying on its earlier decision in State of M.P. v. Chunnilal, the Court ruled that a defect in investigating the SC/ST Act charge cannot be used to quash or discharge the accused from separate IPC charges that were properly investigated. The order of discharge was accordingly restricted to the SC/ST Act charge alone, and the murder-related IPC charges were restored for trial to proceed.
Lesson Learnt
A procedural lapse specific to one special statute (like the requirement of a senior investigating officer under the SC/ST Act) does not automatically invalidate separately investigated and properly framed charges under ordinary criminal law such as the IPC.
