State of Madhya Pradesh v. Deepak
Background
A complainant alleged repeated sword blows to his head and arm, together with threats linked to an earlier report against the attackers' relative. Police filed an attempted-murder case, but the parties subsequently presented a settlement. The High Court quashed the proceedings, and the State challenged that result.
Decision Breakdown
The Supreme Court allowed the State's appeal and directed the magistrate to proceed with the trial. Attempted murder is generally a serious offence against society, although a court examining a quashing request must look beyond the charge's label to the weapon, injuries and available evidence. Here the sword blows, including two head injuries, were serious enough that settlement did not justify ending prosecution. The Court reinstated the case rather than deciding whether the accused were guilty of the charged offence.
Lesson Learnt
A victim's agreement to settle does not automatically terminate a serious assault prosecution. The court must examine the actual injuries and conduct before deciding whether the matter can properly be treated as a private dispute.
