State of Madhya Pradesh v. Shivshankar
Background
During a dispute over distribution of sweets after Holi, Shivshankar slapped members of another family. He then went home, brought a gun and shot an unarmed man in the abdomen, killing him. The High Court reduced the murder conviction and life sentence to culpable homicide and seven years; the State appealed.
Decision Breakdown
The Supreme Court restored the murder conviction and life imprisonment imposed by the trial court. Fetching a gun and intentionally firing at the victim showed a voluntary lethal act. The other side had neither weapons nor exchanged blows, so this was not a mutual sudden fight satisfying the exception to murder. A sudden verbal quarrel alone did not excuse taking unfair advantage of an unarmed victim.
Lesson Learnt
Anger after a quarrel does not by itself reduce murder to a lesser offence. Bringing a weapon and attacking an unarmed person can defeat the sudden-fight exception even where the original dispute was spontaneous.
