State of Punjab v. Gurmit Singh
Background
During a dowry-death trial the prosecution sought to add a man who was the brother of the husband's aunt by marriage. The trial court summoned him under Section 319, but the High Court removed him because he was not a relative of the husband within Section 304B. The State appealed that interpretation.
Decision Breakdown
The Court dismissed the appeal and upheld cancellation of the summons for dowry death. As a penal provision, Section 304B required strict interpretation, and a husband's relative meant a person related by blood, marriage or adoption. The respondent's connection through the husband's uncle's wife did not place him within that description. The Court clarified that this did not prevent prosecution for another offence, such as abetment of suicide, if its separate ingredients were established.
Lesson Learnt
A dowry-death charge requires the relationship specified by the statute, not simply a broad social association with the family. Falling outside that relationship does not confer immunity from other proved criminal offences.
