State of Rajasthan v. Chandgi Ram
Background
Surender was dragged from his home and beaten to death with rods, a pipe and sticks in front of family members and other witnesses. The trial court convicted four attackers, but the High Court acquitted them, doubting witness conduct and delayed reporting. The State challenged that reversal.
Decision Breakdown
The Supreme Court restored the convictions and sentences and directed the accused to surrender. Eyewitness accounts consistently described the attack and were supported by recovered weapons, medical evidence and forensic blood findings. The widow's failure to reach a distant police station late at night, while caring for two traumatised children, reasonably explained reporting the next morning. The High Court had not given convincing reasons to discard the trial court's detailed evaluation of this evidence.
Lesson Learnt
Witness conduct must be assessed in real circumstances, including shock, children's needs and access to police. A delayed complaint does not automatically defeat a case supported by reliable eyewitness and physical evidence.
