Praveen Sharma vs. Darshan Singh & Anr (D S Construction Ltd) and connected matters

The High Court rejected the owner's argument that the driver's criminal acquittal undermined the negligence finding, holding that criminal acquittal (which requires proof beyond reasonable doubt) does not affect a civil MACT finding based on preponderance of probability. It relied on a recent Supreme Court ruling that a charge-sheet creates a prima facie case of negligence which criminal acquittal does not displace. On quantum, the Court accepted an AIIMS Medical Board's assessment of 49% permanent disability (against the Tribunal's earlier 9%), fixed functional disability at 80% given the severe impact on reproductive/urinary function, and added Rs. 10,00,000/- for an attendant (not earlier awarded), enhanced pain-and-suffering compensation, and revised future income loss. Total compensation was raised from Rs. 37,19,000/- to Rs. 53,16,000/- with 9% interest.

Aruna Attri and Ors. vs. Sonu Kashyap and Ors. (Oriental Insurance Co Ltd)

The Court examined testimony from the insurance company's own officials showing that the cover note numbers relied upon by the family had, in fact, been issued for entirely different vehicles and persons, not the truck involved in the accident. It held that a mere photocopy of a cover note, unsupported by proof of premium payment, cannot establish a valid insurance contract, and that the "pay and recover" principle from earlier Supreme Court cases did not apply here because, unlike those cases, there was no proof any legitimate insurance transaction had ever occurred for this vehicle. The appeal was dismissed, though the Court urged the insurance company to investigate how the fraudulent cover notes came to exist in the first place.

Hitesh Singh vs. Ravi and connected matters

The Court held that the criminal conviction was not by itself determinative, but that the site plan and vehicle-damage reports independently showed the scooter was on the correct (left) side of the road and was hit by the bus from the side, pointing to the bus driver's negligence. Relying on a consistent line of Supreme Court judgments, the Court held that triple-riding or the driver lacking a licence does not by itself amount to contributory negligence unless it is shown to have actually caused or worsened the accident: no such causal link was proven here. The Court also upheld the modest sums awarded for medical expenses given the injuries sustained. The appeal was dismissed, and the compensation, along with accrued interest, was ordered to be paid within four weeks.

K Rashik v. National Insurance Company Ltd. and Another

The Supreme Court held that under Section 166(2) of the Motor Vehicles Act, a claimant may file at the place of the accident, where he resides or carries on business, or where the defendant (owner/driver) resides, but this last option does not extend to where an insurer resides or does business, since impleading an insurer as a party is optional and the provision's wording deliberately omits "carries on business" for defendants. Since the claimant himself impleaded the insurer and the insurer raised its objection at the very first stage (not on appeal after an award), Section 21 CPC's stricter "failure of justice" threshold for appellate-stage objections did not apply. On facts, the claimant resided in Chittoor district (not Chennai) and the accident and driver's residence were also in that district, so no part of the cause of action arose at Chennai; the High Court's transfer of the case to the Chittoor Tribunal was correct, and the appeal was dismissed.
