Sushil Ansal v. State Through CBI
Background
Criminal appeals on sentencing in the prosecution arising from the 1997 Uphaar Cinema fire came before a three-judge bench. The order of 19 August 2015 dealt with the sentence of the first two accused, Sushil Ansal and Gopal Ansal.
Decision Breakdown
The Court directed that Sushil Ansal and Gopal Ansal shall stand sentenced to rigorous imprisonment for two years. The sentence would be reduced to the time already served if each paid Rs. 30 crore, Rs. 60 crore in total, within three months towards a trauma centre in Delhi. The order gave only this operative direction, and the Court said its reasons would be recorded later.
Lesson Learnt
The Court allowed a prison sentence to be reduced to time served on payment of a very large sum earmarked for public trauma care in Delhi. The reasons for doing so were left to a later detailed judgment.
