Swapnil v. State of Madhya Pradesh
Background
A husband and his parents faced cruelty, intimidation and dowry-demand charges following complaints by his estranged wife. An earlier complaint had been investigated and closed as a family dispute, and a later complaint repeated the allegations with an additional threat claim. The couple had been living separately, and the husband had withdrawn his restitution petition.
Decision Breakdown
The Court allowed the appeal, quashed the charges and discharged the appellants. After examining the records and sequence of complaints, it found the later allegations vague and lacking details of time and place sufficient to justify the charges. The claimed beating and continued demand were also assessed against the parties' separation and earlier proceedings. In these circumstances the prosecution was considered unfounded and an abuse of criminal process. The Court expressly confined its observations to this criminal case and left the parties' Family Court proceedings unaffected.
Lesson Learnt
Criminal matrimonial charges require sufficient supporting allegations and material; a court may intervene where the record shows abuse of process. Discharge in this case did not decide the separate matrimonial rights and disputes.
