The State of Arunachal Pradesh vs. Kamal Agarwal & Ors.
Background
An FIR was registered in 2017 at Pasi Ghat Police Station, Arunachal Pradesh, alleging cheating and criminal conspiracy (Sections 420/120B/34 IPC) against several accused connected to a business dispute. Some accused sought quashing from the Gauhati High Court (which refused), while others sought the same relief from the Rajasthan High Court (which granted it). This produced conflicting outcomes for people accused in the very same FIR, leading to cross-appeals before the Supreme Court by both the State and one of the accused whose plea had been rejected.
Decision Breakdown
The Supreme Court examined the underlying dispute and found it to be essentially a civil/commercial disagreement dressed up as a criminal case, rather than genuine criminal conduct. It held that allowing the prosecution to continue against some accused while the Rajasthan High Court had already cleared others of the same FIR would be inconsistent and unjust. The Court therefore quashed the entire FIR and all proceedings arising from it, allowed the appeal of the accused who had been refused relief by the Gauhati High Court, and dismissed the State's appeals. It also declined to disturb the Rajasthan High Court's favourable finding for one respondent since the case against everyone else was being quashed.
Lesson Learnt
Criminal proceedings should not be used to settle what is essentially a civil or business dispute, and courts will look at the substance of a dispute, not just the criminal label placed on it, before allowing prosecution to proceed. Consistency also matters: the same set of facts should not lead to widely different outcomes for similarly placed accused persons.
