T.J. Parameshwarappa @ Parameshwarappa @ J.T. Parameshwarappa @ Talalkena Gowdra Parameshwarappa vs The Branch Manager, New India Assurance Co. Ltd. & Ors.
Background
On 15.05.2015 the appellant, working as a cleaner on a tanker lorry, was seriously injured when the lorry's driver drove rashly and crashed into another lorry near Chitradurga, Karnataka, fracturing both his tibia bones. The Motor Accidents Claims Tribunal awarded him Rs. 21,08,400 with 8% interest, but the Karnataka High Court, on cross-appeals by the insurer and the claimant, reduced this to Rs. 7,37,604 with 6% interest. The claimant appealed to the Supreme Court seeking restoration of a higher compensation, given his treating doctor's assessment of 54% permanent disability from the fractures.
Decision Breakdown
The Supreme Court held that the treating doctor's 54% disability assessment was on the higher side and independently assessed the claimant's whole-body permanent disability at 30%, applying settled principles that permanent physical disability and loss of earning capacity are not automatically the same figure and must be separately evaluated by the Tribunal based on the claimant's occupation, age and other factors. Recomputing the compensation heads (pain and suffering, medical expenses, loss of future earning capacity, loss of income during the laid-up period, loss of amenities, conveyance/attendant charges, and future medical expenses), the Court enhanced the total award from Rs. 7,37,604 to Rs. 11,67,405, carrying 6% interest from the date of filing till realization, with part of the sum to be kept in a fixed deposit for the claimant's benefit.
Lesson Learnt
In motor accident claims, a doctor's percentage of permanent physical disability is only medical evidence. It is the Tribunal/Court's job to translate that into an appropriate percentage of loss of earning capacity based on the claimant's actual occupation and circumstances, and claimants should expect compensation heads to be individually scrutinized and recalculated on appeal rather than accepted wholesale.
