Union of India v. Sunil Biyani
Background
Sunil Biyani was being investigated by GST authorities for alleged wrongful availing of Input Tax Credit through circular invoicing. After ignoring several summonses, he sought anticipatory (pre-arrest) bail, which the Bombay High Court rejected, since no formal arrest-authorising order under Section 69 of the CGST Act had yet been passed against him, there was no live threat of arrest to justify anticipatory bail. However, despite dismissing his application, the High Court still granted him protection from arrest for one week after any future Section 69 order was communicated to him. The Union of India appealed to the Supreme Court against this "extra" protection.
Decision Breakdown
The Supreme Court set aside the one-week protection, holding that once a court dismisses an application (whether for bail, or for quashing an FIR) as not maintainable, it cannot simultaneously grant interim relief that only makes sense if the underlying claim survives: interim relief must be ancillary to a live case, not a standalone grant after the case is thrown out. However, the Court went on to address a related legal gap: since a person cannot apply for anticipatory bail until a Section 69 arrest-authorisation order actually exists, but also has no way of knowing when such an order is passed, the Court held that such an order must be communicated to the person concerned (by email, phone, or other means) before any arrest, otherwise the right to seek bail would be practically meaningless. The Court directed that the pending Section 69 order in this case be communicated to Biyani, clarifying that no arrest could occur without such communication first.
Lesson Learnt
Courts cannot hand out interim protection as a consolation prize after ruling that a person's underlying application does not survive; but where a law creates a right (like seeking anticipatory bail against arrest), authorities cannot make that right hollow by withholding the very order that triggers it: the arrest-authorising order itself must be communicated in advance.
