Telecom Regulatory Authority of India v. M/S Polimer Cable Network and Others

The Supreme Court held that TRAI's direction and Show Cause Notice were regulatory/administrative enforcement actions, not an "adjudication" of a dispute between the MSO and LCOs: TRAI never determined the parties' rights, awarded damages, or resolved their contractual dispute; it merely called on the MSO to comply with a subsisting regulation (Regulation 4 of the Interconnection Regulations). Since TRAI is statutorily empowered under Sections 11(1)(b) and 13 of the TRAI Act to issue such directions, and violation attracts penalties only through a competent criminal court under Section 29/34, TRAI had not encroached on TDSAT's exclusive jurisdiction over inter-service-provider disputes. The TDSAT's judgment was set aside and the appeal was allowed.

Union of India v. Sistema Shyam Teleservices Limited

The Supreme Court held the TDSAT's interpretation was "wholly erroneous." It found the 2013 order's own wording plainly fixed 02.02.2012, the date the original licences were quashed, as the start date for the reserve-price liability, not the later date of the order itself; had the Court intended a different start date it would have said so explicitly. The Court agreed with the TDSAT, however, on the end date: liability stopped once the company was issued a formal Letter of Intent (30.04.2013) for the circles it won in the fresh auction, since that document itself started the new 20-year licence term from that date, and for other circles the liability ended when the company actually stopped operating. On interest, the Court agreed the DoT could only charge interest from the date its own show-cause notice's response period expired (December 2014), since the government's own delay in acting on the 2013 order could not be used against the company. The appeal was allowed on these corrected terms, effectively increasing the amount owed compared to the TDSAT's ruling.

State Bank of India v. Union of India & Ors.

The Supreme Court held that spectrum is a finite natural resource and material resource of the community, over which the Union holds ownership and trusteeship for the common good, and it is governed by a complete and exhaustive statutory regime under the Telegraph Act, Wireless Telegraphy Act, and TRAI Act rather than by ordinary property law. It ruled that merely because spectrum is entered as an "asset" in a telecom company's books of account does not bring the entirety of spectrum rights within the sweep of the IBC, treating it as such would let "the tail wag the dog" and would allow insolvency law to override the specialized telecom regulatory framework, which Parliament never intended. Accordingly, the Court held that spectrum allocated to telecom service providers cannot be subjected to CIRP proceedings under the IBC, dismissing the appeals of SBI, the resolution applicant, and the resolution professionals, while allowing the Union of India's appeal in part.

Union of India & Ors. vs Alok Kumar

The Supreme Court held that the governing Master Circular clearly required every direct recruit to pass a written test at the end of training as a prerequisite for confirmation, and that a provisional appointment is only a "recruitment," not a completed "appointment," until training is successfully finished. It found the other four trainees the respondent compared himself to had, in fact, completed the full 52 weeks before being confirmed, so there was no discrimination. The termination was therefore upheld and the High Court's judgment set aside. However, the Court refused to allow recovery of the stipend paid during the second training attempt, since it was paid due to administrative error and not through any fraud or misrepresentation by the respondent.

G.V. Adhimoolam v. The Inspector of Police

The Supreme Court found that the complainant's own version showed he transferred the Rs. 1.5 crore to a company run by his own brother, not to the accused, so there was no inducement by the accused to attract cheating under Section 420 IPC. The six-year delay in lodging the FIR, filed only after the accused had themselves filed a complaint against the complainant, indicated it was a counterblast rather than a genuine grievance. The Court held that a purely civil dispute over an unfulfilled business promise had been given the colour of a crime to use police as recovery agents, and that the alleged verbal abuse and intimidation, even if true, occurred at the accused's own house and did not meet the legal threshold for those offences.

Vishwanath v. The State of Uttarakhand

The Court held that its own December 2024 clarification order squarely covered the applicants' situation: teachers who were already in service as of 10 August 2017 and had completed the 18-month diploma are entitled to be treated as valid diploma holders for applying to other institutions, including State-run schools. It therefore directed the Uttarakhand government to consider the applicants' claims under that clarification and appoint those found eligible within three months, while making clear this could not be used to reopen or disturb the selection process already completed for other candidates. The related transfer petitions and pending Uttarakhand High Court writ petitions were disposed of as satisfied by these directions.
