U.P.S.R.T.C. v. Km. Mamta & Ors.
Background
This order sends the case back; it does not decide the dispute. After a fatal motor accident, the Motor Accident Claims Tribunal awarded compensation of Rs. 24,73,252. The Transport Corporation appealed, arguing contributory negligence by the deceased, and the Allahabad High Court dismissed the appeal in a brief two-sentence order.
Decision Breakdown
This is not a final decision on the dispute. The Court held that the High Court, as a first appellate court, had failed in its duty under Order XLI Rule 31 of the Code of Civil Procedure to set out the facts, address the submissions and give reasoned findings. It set aside the High Court's order and sent the appeal back to the High Court for a fresh decision on merits within six months. The Court said it had not applied its mind to the merits of the issues.
Lesson Learnt
There is no final ruling yet on contributory negligence or the amount of compensation. A first appellate court must set out the facts, deal with the submissions and give reasons.
