Uttar Pradesh State Road Transport Corporation vs. Saurabh Kumar & Anr. and connected matters
Background
A bus belonging to the Uttar Pradesh State Road Transport Corporation struck a motorcyclist in Aligarh, UP, in January 2020, leaving the young rider (then a student) 80% visually disabled with a fractured leg. The MACT awarded him about Rs 64 lakh in compensation and rejected the Corporation's objection that a Delhi court had no jurisdiction. Both the Corporation and the injured claimant cross-appealed.
Decision Breakdown
The Court rejected the Corporation's jurisdiction objection, since the claimant's Aadhaar history and other evidence showed he had actually been living in Delhi for years before the accident. It upheld the finding of rash driving based on the injured witness's identification of the bus and the police FIR. It enhanced the claimant's disability assessment from 80% to 90% and substantially raised his attendant-care compensation from Rs 50,000 to a lump sum of Rs 10 lakh, since he could still move about despite his blindness. Total compensation rose to roughly Rs 79 lakh.
Lesson Learnt
A claimant's identity documents will not automatically defeat a compensation claim just because they show an out-of-state permanent address: actual, proven residence controls which court has jurisdiction; and courts can revisit both the disability percentage and specific compensation heads like attendant care on appeal if the trial court's original assessment appears too conservative.
