Vikas Girsa & Ors. vs. The State Govt of NCT of Delhi & Anr.
Background
A wife had filed an FIR against her husband and in-laws under Sections 498A/406/34 IPC (cruelty and criminal breach of trust) after the couple separated due to marital discord. The couple later divorced, and the parties reached a settlement through the Family Court's counselling cell, under which the husband paid Rs. 42.5 lakh and returned gold/silver articles.
Decision Breakdown
The High Court quashed the FIR and all related proceedings. It found the settlement was voluntary, the wife had received the full settlement amount and confirmed she had no objection to quashing, and that continuing the criminal case would serve no purpose given the dispute was essentially private and did not involve any broader public interest.
Lesson Learnt
In matrimonial disputes involving non-heinous offences, courts will readily quash criminal proceedings once the parties have genuinely and voluntarily settled matters, especially after a divorce has been finalized and settlement terms fully honoured.
