Vineshkumar Mavjibhai Parmar v. Dethali Gopalak Vividh Karyakari Sahakari Mandali Ltd. & Ors.
Background
Under Gujarat's Agricultural Produce Markets Act, 1963, agriculturist members of a market committee are elected by an electoral college made up of managing-committee members of co-operative "credit societies." Here, eight such credit societies were facing winding-up proceedings under the Gujarat Co-operative Societies Act, 1961, and the Registrar deleted their managing-committee members from the voters' list on the ground that societies under winding up could no longer be treated as active credit societies. The Gujarat High Court set aside that deletion, and the objecting voters appealed to the Supreme Court.
Decision Breakdown
The Supreme Court held that the phrase "co-operative societies dispensing agricultural credit" in the Markets Act is merely descriptive of the purpose for which such societies are established, not a requirement that they be actively dispensing credit at every moment, so a society facing an interim winding-up order (which may or may not ever become final) does not automatically lose its character as a credit society. The Court reasoned that officers of a society facing only an interim winding-up order continue to hold office and lose only specific rights under the Societies Act; they are not stripped of every statutory function, including the separate right to vote in market committee elections conferred by a different statute. Interpreting the law otherwise, the Court held, would create impractical line-drawing problems and unfairly punish societies whose winding-up proceedings might ultimately be dropped. All eight appeals were accordingly dismissed.
Lesson Learnt
Being under investigation or in interim winding-up proceedings does not automatically strip an organization (or its officers) of every right or function given to it under a different law: rights are curtailed only to the extent the relevant statute actually says so, and only once a final (not merely interim) order takes effect.
