Vinod and Ors. vs. State (NCT of Delhi) and Anr.
Background
The petitioners sought quashing of an FIR registered under Sections 406/498A/34 IPC at PS Aman Vihar, filed on a complaint by the wife (respondent no.2). The marriage between petitioner no.1 and respondent no.2 had already ended in divorce, and no children were born of the marriage.
Decision Breakdown
The complainant appeared in court, confirmed she had compromised all disputes with the petitioners, and had received the balance settlement amount of Rs. 2,00,000 (full and final settlement of her stridhan and maintenance claims) that day. The State had no objection. Satisfied that pushing the parties through a full trial would serve no purpose, the Court quashed the FIR and all consequent proceedings.
Lesson Learnt
Where a matrimonial FIR is genuinely settled between the parties and the complainant no longer wishes to prosecute, courts will readily quash such proceedings rather than force an unnecessary trial.
