Vivek Sharma and Anr. vs. The State Govt of NCT of Delhi and Anr.
Background
A husband was booked in 2024 for cruelty, criminal breach of trust, and related offences after his wife's father complained that the husband had abandoned his ailing wife (who suffered from Multiple Sclerosis) and filed for divorce. The wife tragically died in December 2024 during the case's pendency, and the husband had by then withdrawn his divorce petition. The wife's father and the husband later reached a full compromise and jointly asked the Court to quash the FIR.
Decision Breakdown
The Court quashed the FIR and all related proceedings, reasoning that with the wife (the key witness to the alleged cruelty) no longer alive, and her father, also a prosecution witness, now unwilling to testify and freely consenting to the settlement, continuing the criminal case would serve no real purpose and had virtually no chance of resulting in conviction. The compromise agreement was ordered placed on the trial court's record.
Lesson Learnt
Courts can quash even fairly serious criminal cases (like matrimonial cruelty charges) on genuine compromise between the parties where continuing the prosecution has become practically pointless and involves no wider public interest.
