Anil Jagannath Rana v. Rajendra Radhakishan Rana
Background
Partners litigated a dispute about their business and properties in a civil suit. The defendants sought arbitration, but the plaintiffs opposed it and the civil court's refusal to refer the dispute became final. Near the end of the trial, those plaintiffs nevertheless applied to the High Court for appointment of an arbitrator.
Decision Breakdown
The Supreme Court allowed the defendants' appeal, set aside the appointment order and awarded ₹25,000 in costs. Having chosen the suit and successfully opposed referral, the plaintiffs could not reopen the finally decided issue by taking the separate arbitrator-appointment route under Section 11. The Court applied issue estoppel and res judicata. Section 8(3), which permits arbitration while a referral application is pending, did not authorise reopening a final judicial refusal to refer these parties' dispute.
Lesson Learnt
A party cannot ordinarily revive a finally rejected arbitration route through a later appointment application for the same dispute. Challenge the original referral decision through the proper process instead of trying to reopen it after the civil trial has advanced.
