Ashok Kumar vs. New India Assurance Co. Ltd.
Background
The appellant's insured truck was stolen in 2008 after his driver briefly left it unattended with the key in the ignition while checking an address for delivery. An FIR was lodged the very next day and the insurer was informed shortly after, but the vehicle was never recovered. The insurer repudiated the claim years later, citing breach of policy conditions requiring immediate notice and safeguarding of the vehicle. The claimant's first consumer complaint was mistakenly withdrawn by his lawyer without proper instructions; he then filed a fresh complaint, which succeeded before the District Forum and State Commission (75% compensation on a "non-standard" basis), but the National Consumer Disputes Redressal Commission reversed this, holding the second complaint was barred by the earlier withdrawal and that the policy breach was fatal.
Decision Breakdown
The Supreme Court held that the National Commission wrongly allowed the insurer to raise the "barred by withdrawal" argument for the first time in revision, when it had not even been argued before the State Commission, and further found the National Commission had proceeded on a factually incorrect premise about what the earlier complaint concerned. On the merits, relying on its precedents in Gurshinder Singh, Nitin Khandelwal, and Amalendu Sahoo, the Court held there was no breach of the notice condition since the FIR and insurer intimation were prompt, and that leaving keys in the ignition briefly while making inquiries did not amount to a "fundamental breach" justifying total repudiation, at most it warranted a proportionate reduction. The Court restored the 75% non-standard settlement awarded by the District Forum and State Commission.
Lesson Learnt
An insurer cannot deny a genuine theft claim outright merely because of a minor, non-fundamental lapse (like briefly leaving keys in the ignition): such breaches at most justify a proportionate reduction in payout, not a complete denial of the claim; and a client should not be penalized for their lawyer's unauthorized withdrawal of a case.
