Dineshan K.K. v. R.K. Singh and Another
Background
This order does not decide the main case. An Assam Rifles employee alleged that officials had not complied with directions concerning his redesignation and pay parity. The High Court had granted those directions, and the Supreme Court had dismissed the Union's appeal. He brought contempt proceedings in the Supreme Court after the alleged continuing non-compliance.
Decision Breakdown
This is not a final decision on the main case. The Court accepted that the High Court's judgment had merged into its appellate order. Nevertheless, because the operative directions had originated in the High Court and could effectively be enforced there, the Court exercised its constitutional powers to direct the employee to bring an appropriate contempt petition in that court within two months. The High Court was to consider it according to law after hearing all parties. The Supreme Court disposed of the petition without deciding whether anyone had committed contempt.
Lesson Learnt
Where the Supreme Court has simply affirmed High Court directions on appeal, it may direct an enforcement complaint back to the High Court for effective adjudication. That procedural choice does not by itself establish wilful disobedience or impose punishment.
