Dr. Sonia Verma & Anr. vs The State of Haryana & Anr.
Background
The appellants, two doctors running a maternity and trauma hospital in Rewari, Haryana, had been renting the hospital premises from the son of the second respondent. After they purchased the land via a registered sale deed, a dispute arose and an FIR was registered against them under IPC provisions including cheating, criminal breach of trust, forgery and criminal conspiracy. The Punjab and Haryana High Court had declined to quash the FIR, so the doctors appealed to the Supreme Court.
Decision Breakdown
The Supreme Court held that the dispute was essentially a civil/commercial one concerning the validity of a sale deed, dressed up as a criminal complaint. Relying on settled precedent, the Court reiterated that where a civil remedy is available and has in fact already been invoked (a civil suit was pending between the parties), the High Court should not hesitate to quash criminal proceedings to prevent abuse of the court's process. The Court set aside the High Court's order and quashed the FIR and all consequent criminal proceedings, while clarifying that the pending civil suit between the parties would continue to be decided on its own merits.
Lesson Learnt
Criminal law cannot be used as a shortcut to settle what is really a civil or commercial dispute (like a property/sale-deed disagreement); courts will quash such FIRs where a civil remedy already exists and is being pursued.
