Gulf Goans Hotels Co. Ltd. v. Union of India
Background
Goa hotels and beach-property owners faced demolition despite having construction permissions. Authorities relied on earlier environmental guidelines restricting building near the high-tide line. The buildings had been completed before the statutory Coastal Regulation Zone notification took effect in February 1991.
Decision Breakdown
The Supreme Court set aside the demolition orders and the High Court decisions upholding them. The earlier guidelines had not been issued under a statute, duly authenticated as government orders or properly published so as to bind citizens. International environmental commitments did not by themselves convert those communications into enforceable domestic restrictions. Environmental concerns could not justify adverse action based on guidelines lacking the legal authority required in these cases.
Lesson Learnt
Restrictions affecting property need a valid legal basis and proper publication. This ruling concerned pre-1991 constructions and the particular earlier guidelines; it did not authorise disregarding binding coastal regulations.
