IVT-VLT-CC Joint Venture v. Mahanadi Coalfields
Background
A coal-transport joint venture disputed how Mahanadi Coalfields calculated wage compensation under its contract. It wrote to a mining officer seeking revised calculations and then filed a writ petition when it received no response. The High Court dismissed the petition as a commercial-contract dispute.
Decision Breakdown
The Supreme Court disposed of the appeal by directing the contractor first to seek resolution from the Engineer Incharge under Clause 12 of the contract. Its earlier letter to the Staff Officer (Mining) asked for revised calculations but did not invoke the agreed dispute-resolution mechanism. The Court therefore found that the contractor had not exhausted that contractual channel. It left suitable legal remedies available afterwards and did not decide the correct wage-compensation calculation.
Lesson Learnt
When a contract requires a dispute to be submitted first to a named officer, use that procedure clearly and address the proper person. A general complaint to another official may not satisfy the agreed first step before litigation.
