M/s Acme Cleantech Solutions Private Limited v. M/s United India Insurance Company Limited & Anr.
Background
The appellant's solar power plants were damaged by storms, and it filed a consumer complaint before the NCDRC seeking payment of its insurance claim. The insurer did not file its written statement within the time allowed by law, and only after that deadline passed did it formally repudiate (reject) the claim and seek dismissal of the complaint as premature. The NCDRC directed the appellant to amend its complaint to address the repudiation and allowed the insurer a fresh opportunity to file a written statement.
Decision Breakdown
The Supreme Court held that a complainant is the "dominus litis" - the master of its own case - and cannot be compelled by a tribunal to amend its complaint against its wishes. It set aside the part of the NCDRC's order directing the appellant to amend its complaint and giving the insurer a fresh chance to file a written statement, since this would unfairly take away the appellant's right to argue that the insurer's written statement was already time-barred. The Court left it to the appellant to choose between pursuing the existing complaint, amending it, or withdrawing it to file a fresh one, without expressing any opinion on the merits of the insurance dispute itself.
Lesson Learnt
A person who files a consumer complaint (or lawsuit) controls how their own case proceeds and cannot be forced by the tribunal to change their pleadings; and a defendant who misses the legal deadline to respond does not get a free second chance through a procedural order.
