MS Atrium Newgen Diagnostics vs. MS Clix Capital Services Pvt Ltd & Ors.
Background
A diagnostics company and a finance company were in dispute, and the matter had come before the High Court. By the time of the hearing, counsel for both sides confirmed that the underlying claim had already been decided, and rejected, by the Arbitrator himself.
Decision Breakdown
Since the Arbitrator had already resolved the very claim this petition was built around, the Court held that the petition no longer served any purpose ("rendered infructuous") and dismissed it on that basis, without going into any other issue.
Lesson Learnt
Once an arbitrator has finally ruled on the underlying dispute, any related court application that was essentially asking the court to act on that same dispute typically becomes pointless and gets dismissed, rather than separately decided.
