M/S Hotel Tramboo Continental v. Home Department Civil Secretariat, Govt. of Jammu and Kashmir
Background
A hotel had let out rooms to the Jammu and Kashmir Government for use by different departments (Police and Estate) between 1997 and 2008. A dispute arose over what rent was payable, since the Police Department had been paying Rs. 200/day/room under a 1998 Government Order, while the Estate Department disputed paying the same rate for the rooms it occupied.
Decision Breakdown
The Supreme Court found no rational basis for the Estate Department to pay a different rate than the Police Department for materially similar occupation. Rather than fixing the rent itself, the Court disposed of the appeals by directing the Chief Secretary of Jammu and Kashmir, as the authority competent to decide rates across departments, to determine the rent payable for 1997-2008 within four months, after hearing both parties. The Court further directed that if the rate fixed exceeds Rs. 200/day, the Government must pay the shortfall within three months; if it is fixed lower, the hotel must refund the excess within three months.
Lesson Learnt
Courts can finally dispose of a case by directing the appropriate administrative authority to resolve a technical/rate-fixing question, while laying down clear consequences and timelines so the matter does not drag on indefinitely.
