Navniraman Development Consultants (I) Pvt. Ltd. v. The Divisional Commissioner and President District Sports Complex Executive Committee
Background
This order sends the case back; it does not decide the dispute. An arbitral tribunal awarded a contractor about Rs. 25.64 lakh against a government body for unpaid bills, and a District Judge reduced this to about Rs. 7.15 lakh on objections under Section 34 of the Arbitration Act. A single High Court judge dismissed the contractor's appeal under Section 37 in a one-paragraph order, passed in the absence of both sides' counsel, with no facts or reasons.
Decision Breakdown
This is not a final decision on the dispute. The Court held that the unreasoned dismissal could not stand and that the High Court should have followed the Civil Procedure Code provisions for deciding an appeal when parties are absent. It set aside the High Court's order and sent the appeal back to the High Court to be decided afresh on merits. The Court said it had refrained from recording any finding on the merits.
Lesson Learnt
A court deciding an appeal in the absence of both parties must still follow the procedure under Order 41 of the CPC and give reasons. There is no final ruling yet on how much, if anything, the contractor is owed.
