Thota Venkateswara Rao v. The State Election Commission and Ors.
Background
This order sends the case back; it does not decide the dispute. Three appeals concerned municipal members who were suspended from membership. The dispute was whether they belonged to a recognised political party and whether a particular statutory disqualification rule applied to them. The High Court had referred a pure question of law to the Presiding Officer in the election proceedings instead of deciding it.
Decision Breakdown
This is not a final decision on the dispute. The Court held that the High Court was wrong to refer a pure question of law to the Presiding Officer rather than decide it itself. It set aside the two High Court judgments under appeal and remitted all three matters to the High Court to decide the three framed questions on their merits. The Court said it had not considered the matters on merits and left both sides free to raise all contentions afresh.
Lesson Learnt
There is no final ruling yet on whether the municipal members were validly disqualified. A High Court should decide a pure question of law itself rather than delegate it to an election officer.
