Medical Council of India v. Kalinga Institute of Medical Sciences (KIMS) & Ors.
Background
The Medical Council of India, the national regulator for medical colleges, appealed against an order concerning the inspection of Kalinga Institute of Medical Sciences (KIMS) in Odisha. Senior counsel for the college told the Court that a batch of 50 additional students was not undergoing studies. The dispute centred on the role of the Odisha state medical education directorate (DMET) and the timing of the inspection.
Decision Breakdown
The Court directed that the Odisha DMET should not take part in the inspection process. It extended the time for carrying out the inspection by four weeks from the date of the order. MCI's counsel said the inspection concerned the 2016-17 academic year, but the college opposed recording that statement, and the order does not separately record it. The Court disposed of the appeal as partly allowed and modified the impugned order only to that extent.
Lesson Learnt
A regulator's inspection of a medical college can be directed and timed by the Supreme Court, which can also change which state agencies take part. Colleges and regulators should follow the exact dates and participants set in the court's order.
