Medical Council of India v. Ruxmaniben Deepchand Gardi Medical College & Anr.
Background
The Medical Council of India (MCI) appealed against a High Court order that had gone in favour of Ruxmaniben Deepchand Gardi Medical College, in a dispute over the college's permission/recognition status. The appeal raised the same underlying issue that the Supreme Court had already decided a few weeks earlier in a separate case concerning medical college recognition.
Decision Breakdown
Leave was granted and the appeal was allowed purely by applying the Court's own recent decision dated 20 August 2015 in Royal Medical Trust (Regd.) & Anr. vs. Union of India & Anr. (Writ Petition (C) No. 705/2014), which had settled the governing legal principle. Following that precedent, the Court set aside the High Court's order under challenge. Any pending application in the matter was disposed of, with no order as to costs.
Lesson Learnt
When the Supreme Court has already settled a legal question in one case, it will routinely apply that same ruling to dispose of other pending appeals raising an identical issue, rather than re-litigating the point each time, so related cases often get resolved quickly once a "lead" judgment is delivered.
