Precious Jewels v. Varun Gems
Background
Members of the Rakyan family operated neighbouring jewellery shops in Delhi. Varun Gems, trading as Rakyan's Fine Jewellery, obtained an interim order stopping the defendants from trading as Neena and Ravi Rakyan. The defendants argued that these were their own names and that the Trade Marks Act protected their honest use.
Decision Breakdown
The Court allowed the appeal and set aside the interim injunction. Section 35 protects bona fide use of one's own name, and the defendants' bona fides were not disputed. Many family members worked in jewellery, and the Court found no similarity between the shops' hoardings. On this preliminary material, the plaintiff had not established a prima facie case warranting restraint. The Court expressly confined its observations to the interim question: the trial court was to decide the pending suit on the evidence, without treating these observations as final findings.
Lesson Learnt
Honest use of a person's own name can matter when a trade-mark owner seeks an injunction. This interim ruling preserved the business name pending trial rather than finally deciding all trade-mark rights.
