Ramadhar Singh & Ors. v. Committee of Mgt. S.M.S.P.S. Itali & Ors.
Background
The appellants challenged a 2008 election to the Committee of Management of Shri Manas Shiksha Prasar Samiti, Itaili, a body whose committee term runs for three years. By the time the appeal reached the Supreme Court, fresh elections had already been held in 2011 and 2014, with another due soon. The appellants had also filed a related civil suit before the Civil Judge, Mau, which was still pending.
Decision Breakdown
The Supreme Court held that, given two subsequent elections had already taken place, there was nothing left on facts for it to decide, so the challenge to the 2008 election was moot. It accordingly dismissed the appeal, clarified that the Committee presently in office would continue for its remaining term, and recorded the appellants' counsel's statement that the pending civil suit was not being pressed, directing that suit be dismissed and struck off as well. The Court left open all other questions of law raised in the appeal, since it decided the matter purely on the ground of the dispute having become infructuous with time.
Lesson Learnt
A legal challenge to an election or appointment can become infructuous simply through the passage of time once fresh elections have superseded the disputed one: courts will decline to rule on stale factual disputes even while leaving the underlying legal questions technically open for a future case.
