Small Industries Development Bank of India (SIDBI) & Anr. v. M/S Emosons Organics Ltd. & Anr.
Background
SIDBI, a secured creditor, sought to recover its dues from the borrower, M/S Emosons Organics Ltd., by invoking the SARFAESI Act (the law allowing banks and financial institutions to enforce security interests over secured assets without going through a lengthy civil suit). The Jammu and Kashmir High Court had ruled against the bank, apparently on the footing that the SARFAESI Act did not extend to the State of Jammu and Kashmir at the relevant time, and SIDBI appealed to the Supreme Court.
Decision Breakdown
The Supreme Court noted that this very question, whether the SARFAESI Act applies in Jammu and Kashmir, had already been conclusively decided in its earlier ruling in State Bank of India v. Santosh Gupta, (2017) 2 SCC 538, which held that the Act does apply there. Applying that precedent directly, the Court set aside the High Court's judgment, allowed SIDBI's appeal, and clarified that the bank was free to proceed further to enforce its security interest under the SARFAESI Act in accordance with law.
Lesson Learnt
Once the Supreme Court has settled a legal question in one case, that ruling binds and resolves all other pending cases raising the identical question: here, confirming that national banking-recovery laws like SARFAESI could be used by lenders in Jammu and Kashmir just as in the rest of India.
