St. Mary's Hotel (P) Ltd. & Anr. v. Kottayam Dist. Coop. Bank Ltd. & Others
Background
St. Mary's Hotel had an appeal pending before the Debt Recovery Appellate Tribunal (DRAT) at Chennai against recovery action taken by Kottayam District Cooperative Bank, and the DRAT had directed it to pay Rs. 65 lakh as a pre-deposit condition for that appeal to be heard. While that appeal was pending, the hotel separately approached the Supreme Court by way of this writ petition, and under an interim order of the Supreme Court it had already paid Rs. 2 crore to the Bank, which the Bank kept in a separate account.
Decision Breakdown
Since the Rs. 2 crore already paid by the petitioners far exceeded the Rs. 65 lakh pre-deposit demanded by the DRAT, the Supreme Court directed that the deposited amount be appropriated towards the petitioners' dues, and held it was unnecessary for them to pay the further Rs. 65 lakh ordered by the Tribunal. The Court directed the DRAT to decide the pending appeal preferably within three months, and ordered that no coercive recovery steps be taken under the SARFAESI Act while that appeal remained pending. The broader legal question about the interplay between the SARFAESI Act and the Multi-State Cooperative Societies Act was expressly left open for another occasion, and the writ petition (along with the related application) was disposed of on these terms.
Lesson Learnt
When a borrower has already paid more than what a tribunal's pre-deposit condition requires, courts can adjust that payment against the demanded deposit instead of insisting on a fresh, duplicate payment, and while an appeal is genuinely pending, courts can pause coercive recovery action to let that appeal be heard on its merits.
