The Correspondent, Schaffter Higher Secondary School, Tirunelveli & Ors. Etc. v. A.M. Sankey John & Anr. Etc.
Background
The Madurai Bench of the Madras High Court had found that the termination of several private respondent-teachers by the school management was invalid for violating principles of natural justice, and the management appealed to the Supreme Court. While the appeal was pending, and pursuant to the Court's own interim directions, the District Education Officer, Tirunelveli, passed a fresh order holding that the authority which had originally appointed the teachers was not competent to do so, meaning their appointments could not be approved.
Decision Breakdown
Because this intervening administrative order materially changed the factual landscape of the dispute (which had been confined by the High Court to natural-justice grounds alone), the Supreme Court set aside the High Court's judgment and remanded the matter for fresh consideration. It granted the affected teachers liberty to challenge the District Education Officer's order within the same pending writ appeals before the High Court, directed that two other similarly-placed teachers be treated the same way, and asked the High Court to decide the matter afresh and expeditiously, given it was an old case.
Lesson Learnt
When a significant new fact or administrative decision emerges while an appeal is pending, the Supreme Court may send the case back to the High Court for a fresh, complete look rather than deciding the appeal on the older, now-incomplete record, ensuring both sides get a chance to address the new development.
