Viman Vaman Awale v. Gangadhar Makhriya Charitable Trust
Background
Viman Vaman Awale joined a Maharashtra school as a qualified assistant teacher in 1979, a year before another teacher. That colleague acquired a B.Ed. earlier and was promoted to headmaster in 2010. Awale challenged her supersession, but the tribunal and High Court treated the earlier B.Ed. as determining seniority.
Decision Breakdown
The Court allowed Awale's appeal and directed her appointment as head of the school in place of the colleague within four weeks. She already held the prescribed D.Ed. qualification when initially appointed, so her continuous service counted for seniority. Acquiring the higher B.Ed. qualification later did not erase that earlier lawful service. Both teachers met the headship qualifications when the post became available, and the relevant rules did not give priority merely for acquiring those qualifications sooner. Authorities concerning teachers initially appointed without required qualifications did not apply to her situation.
Lesson Learnt
Eligibility for promotion and seniority are distinct. A properly qualified teacher's earlier service cannot be disregarded merely because a junior gained a higher qualification first, unless the governing rules provide otherwise.
