Ahmedabad Municipal Corporation & Anr. etc. v. Rajubhai Somabhai Bharwad & Anr. etc.
Background
This order sends the case back; it does not decide the dispute. A workman dismissed by the Nava Naroda Gram Panchayat was awarded reinstatement by the Labour Court on the basis of a compromise signed by the Panchayat's Sarpanch. The Gram Panchayat and the Ahmedabad Municipal Corporation challenged the award, and both a Single Judge and a Division Bench of the High Court ruled against them.
Decision Breakdown
This is not a final decision on the dispute. The Court held that a Sarpanch has no authority under Section 101 of the Gujarat Panchayats Act, 1993 to enter into a compromise for the Gram Panchayat without a proper resolution, and that the Labour Court had failed to scrutinise this. It set aside the Single Judge's order and the Labour Court's award and sent the matter back to the Labour Court for fresh adjudication. It expressed no opinion on the merits and did not decide whether the appeal before the Division Bench was maintainable.
Lesson Learnt
A Sarpanch cannot bind a Gram Panchayat to a compromise without the Panchayat's own resolution. There is no final ruling yet on whether the workman is entitled to reinstatement.
