Assistant Provident Fund Commissioner, EPFO and Anr. v. The Management of RSL Textiles India Pvt. Ltd. Thr. Its Director
Background
The EPFO had imposed damages on the respondent employer under Section 14B of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952, for delayed deposits. The Madras High Court quashed this action because neither the original nor the appellate EPFO authority had recorded any specific finding on the employer's mens rea (guilty intent) or actus reus (wrongful act): they had only noted that financial difficulty was not an excuse.
Decision Breakdown
The Supreme Court held the issue was already settled against the EPFO by its own earlier decision in Mcleod Russel India Ltd. v. Regional Provident Fund Commissioner, which held that the presence or absence of mens rea/actus reus is a determinative factor in imposing damages under Section 14B and in deciding how much to impose. Since the High Court had correctly found no such finding was ever recorded by the EPFO authorities, the Supreme Court dismissed the EPFO's appeals.
Lesson Learnt
Before penalising an employer with damages for EPF default, the authorities must actually record a finding on the employer's fault (mens rea/actus reus): simply rejecting "financial crisis" as an excuse is not enough.
