B. Kodappa & Ors. v. Lakkamma (D) By LRs. & Ors.
Background
In an earlier order dated 03.10.2016, the Supreme Court had noted that the parties to this civil appeal appeared willing to settle their dispute, waived the pending notice requirement, and referred them to the Mediation Centre at the Bangalore High Court. The Bangalore Mediation Centre subsequently informed the Court, by letter dated 13.02.2017, that the parties had reached and signed a Memorandum of Settlement dated 04.02.2017.
Decision Breakdown
With the signed settlement on record, the Supreme Court disposed of the appeal strictly "in terms of" the Memorandum of Settlement, directing that it form part of the judgment itself, with no order as to costs.
Lesson Learnt
Court-annexed mediation can fully and finally resolve even a pending Supreme Court appeal, once parties reach and formally sign a settlement, the Court will typically give it binding legal effect rather than re-deciding the underlying dispute on merits.
