Cimco Birla Ltd. v. Rowena Lewis
Background
Rowena Lewis obtained a 1996 labour award directing reinstatement, continuity of service and full back wages for wrongful termination. The employer's challenge and restoration application were dismissed, making the award final, but enforcement required further proceedings. Cimco Birla appealed against the order compelling compliance, despite Lewis having been reinstated during the litigation.
Decision Breakdown
The Supreme Court dismissed the employer's appeal and awarded Lewis ₹50,000 in costs. Enforcement proceedings could not reopen the finally settled termination dispute or revive the rejected claim that the Bombay office had closed. The Court noted that the employer's repeated litigation had withheld the worker's monetary benefits for approximately 27 years. Lewis could withdraw the back-wage deposit and accrued interest, with the receipt adjusted against the enforceable award. The employer had to comply with the Industrial Court's payment directions within four weeks.
Lesson Learnt
A worker who has obtained a final reinstatement and back-wages award may enforce it without relitigating the dismissal. An employer's prolonged resistance to compliance can result in additional costs as well as the outstanding payment obligation.
