Delhi Development Authority v. Ajit Singh and Anr.
Background
DDA had old land acquisition proceedings pending against Ajit Singh's land, but had neither taken physical possession nor paid compensation by the time the 2013 land acquisition law took effect. The High Court ruled that the acquisition had lapsed under Section 24(2) of the new Act, and DDA appealed that ruling to the Supreme Court.
Decision Breakdown
The Court held the point was already decided against DDA in its companion judgment in Civil Appeal No.8477 of 2016, and dismissed the appeal, confirming the lapse of acquisition. It granted DDA a one-year window to initiate fresh acquisition proceedings by issuing a new Section 11 notification, failing which DDA, if in possession, would have to return the land to its original owner.
Lesson Learnt
Government authorities cannot sit indefinitely on acquired land without paying compensation or taking possession; the 2013 Act gives such delayed acquisitions a hard legal expiry date, protecting landowners' rights.
