Delhi Development Authority v. Banwari Lal Sharma & Ors.
Background
DDA appealed against a ruling favouring respondent Banwari Lal Sharma in a land acquisition matter, again raising the same legal issue already decided against DDA the same day in a lead case.
Decision Breakdown
The Court held the issue was covered, in principle, against DDA by its judgment in Civil Appeal No. 8477 of 2016 (arising out of SLP(C) No. 8467 of 2015), and dismissed the appeal accordingly. Considering the facts, DDA was granted one year to exercise its liberty under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, to re-initiate acquisition through a fresh Section 11 notification.
Lesson Learnt
Another case in the same cluster: authorities get a strict one-year window to restart a lapsed land acquisition, or must return possession to the original owner.
