Delhi Development Authority v. Devraj and Ors.
Background
DDA appealed against a ruling in favour of the respondent, Devraj, regarding land DDA had sought to acquire. As in a companion batch of DDA appeals heard the same day, the central question was whether DDA's old acquisition proceedings had lapsed under Section 24(2) of the 2013 Act, an issue already decided against DDA in a connected lead case (Civil Appeal No. 8477 of 2016).
Decision Breakdown
The Court held the issue was already covered against DDA by the lead judgment in Civil Appeal No. 8477 of 2016 and dismissed the appeal. It nonetheless gave DDA one year from the date of the order to initiate fresh acquisition proceedings by issuing a fresh notification under Section 11 of the 2013 Act; failing that, if DDA remained in possession of the land, it was directed to return physical possession to the original landowner. Pending applications were disposed of.
Lesson Learnt
A land-owning authority whose old acquisition has lapsed for procedural delay cannot keep relying on the old proceedings indefinitely: courts can grant one final, time-bound window to restart acquisition properly, failing which possession must revert to the landowner.
